The Louisiana Department of Environmental Quality (LDEQ), Waste Permits Division, is proposing to approve a petition for no alternatives to land disposal of prohibited wastes by deepwell injection submitted by Mosaic Fertilizer, LLC-Uncle Sam Plant located at 7250 LA Hwy 44, Uncle Sam, St. James Parish, Louisiana.  The decision of the proposed petition is based upon the review that there are no economically reasonable and environmentally sound alternatives to disposal of prohibited hazardous wastes into injection wells pursuant to LAC 33:V.2273.C.  The United States Environmental Protection Agency (USEPA) has issued a final determination to Mosaic for an exemption to allow land disposal of a prohibited waste (D002, D004, D005, D006, D007, D008, D009, D010, D011) by deepwell injection (Waste Disposal Wells No. 001 and No. 002.  Well No. 003 is not constructed, but will apply for an exemption at a later date if needed) in accordance to 40 CFR Part 148, Subpart C.  Also, the Louisiana Department of Natural Resources (LDNR) has issued a final order for the drilling, construction and operation of three (3) Class 1 underground injection wells (No. 001, No. 002, and No. 003) for the disposal of a prohibited hazardous waste.

A final decision to approve or deny the petition for no alternatives to land disposal of a prohibited waste by deepwell injection will be made after the close of the 45-day comment period (LAC 33:V.2243) which ends at 4:30 pm CST, Monday, March 3, 2014.  Comments and requests for a public hearing or notification of the final decision can be submitted via personal delivery, U.S. mail, email, or fax.  Delivery may be made to the drop-box at 602 N. 5th St., Baton Rouge, LA 70802.  U.S. Mail may be sent to LDEQ, Public Participation Group, P.O. If LDEQ finds a significant degree of public interest, a public hearing will be held.  LDEQ will send notification of the final permit decision to the applicant and to each person who has submitted written comments or a written request for notification of the final decision.


This final action and related documents are available for review and copying (all documents copied will be subject to a $0.25 charge per copied page) at the LDEQ, Public Records Center, Room 127, 602 North 5th Street, Baton Rouge, LA.  Viewing hours are from 8:00 a.m. to 4:30 p.m., Monday through Friday (except holidays).  The available information can also be accessed electronically on the Electronic Document Management System (EDMS) on the DEQ public website at www.deq.louisiana.gov.
