OCCIDENTAL CHEMICAL CORPORATION


The LDEQ, Office of Environmental Services, is accepting written comments on a draft Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for Occidental Chemical Corporation, Geismar Facility, P.O. Box 227, Geismar, LA 70734.  The facility is located at 8318 Ashland Road, Geismar, Ascension Parish.  Upon the effective date of the final permit, the LPDES permit shall replace the previously issued LPDES permit.

The principal discharge from this existing source is made into the Mississippi River, waters of the state classified for primary contact recreation, secondary contact recreation, propagation of fish and wildlife and drinking water supply. The facility also discharges to an unnamed drainage ditch to Smith Bayou, thence to Bayou Francois, waters of the state classified for primary contact recreation, secondary contact recreation and propagation of fish and wildlife.  Under the SIC Codes 2869, 2812, 2813 and 2819, the applicant proposes to discharge treated process wastewaters, process and non-process area stormwater runoff, utility wastewaters, recovered groundwater, sanitary wastewater, and miscellaneous utility wastewaters from an existing organic and inorganic chemical manufacturing facility.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

The principal discharge from this  source will be made into an open ditch, thence to Bayou D’Inde and thence into the Calcasieu River via an effluent pipe, waters of the state classified for primary contact recreation, secondary contact recreation and propagation of fish and wildlife.  Under the SIC  1321, the applicant proposes to discharge cooling tower blowdown water and reject water from the amine/caustic water make-up treatment unit from a proposed natural gas processing facility.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

Court Ruling on the Right to Intevene in Environmental Regulatory Proceedings

Vallery v. Louisiana State Dept. of Environmental Quality
Court of Appeal of Louisiana, First Circuit.May 2, 2012--- So.3d ----2011-1315 (La.App. 1 Cir. 5/2/12) re hearing denied, August 15, 2012.

Ernie Vallery filed suit asking the court to order LDEQ to conduct a public hearing on Vanguard Synfuels' application for a LPDES permit. The Louisiana Environmental Action Network and Howard Charrier filed petitions in 2007 seeking to intervene in the Vallery suit as plaintiffs. The court granted Vallery the relief sought and ordered LDEQ to hold a public hearing on the Vanguard Synfuel's permit application.


"Original jurisdiction"refers to the tribunal empowered to conduct adjudications in the first instance. It does not refer to judicial review of decisions of administrative agencies.

A person or group that seeks to intervene must do so before the tribunal with original jurisdiction has ruled. There is no right to  intervene at the judicial review stage of the proceeding. According to La. R.S. 30:2050.11, an aggrieved person is granted the right to intervene as a party in an environmental regulatory proceeding at the adjudicatory hearing stage.

The Vallery decision intended to clarify the procedural window available to intervene. An environmental action group, or concerned citizens must intervene prior to the administrative ajudication. The decision is ambigous, however. The court implies that since the appropriate remedy from an adverse administrative proceeding is an appeal to the District Court in the 19th Judicial District, the party seeking to intervene can join the action via the appeal to the 19th Judicial District Court.

Once an adjudication has occurred, the proper remedy for an aggrieved person to contest a final decision or order of the LDEQ is to appeal the decision or order in accordance with La. R.S. 30:2050.21.  Louisiana Revised Statute 30:2050.21 expressly provides that “[a] petition for review must be filed in the [Nineteenth Judicial District Court] within thirty days after notice of the action or ruling being appealed has been given.”

The conflict is best resolved in favor of intervention prior to the administrative adjudication.

CONSTRUCTION / DEMOLITION DEBRIS AND WOODWASTE LANDFILLS


1.The Applicant must complete the C&D-G Notice of Intent (NOI) form.
2. Within sixty (60) days after submittal of the NOI, the applicant is required to provide proof of publication of a "public notice" along with a copy of the public notice that has been published once in the local newspaper serving the location of the proposed discharge or, in the absence of a local newspaper, in a newspaper with a general circulation at that location.
3. Every item on the form must be filled out.
4. The applicant must file an original and one copy of the completed form, a marked USGS Quadrangle map (or equivalent) and the site/flow diagrams. 
5. Completion of the NOI may not fulfill all state, federal or local requirments for facilities or operations of your specific size and type. 
5. If your dischare is into a state highway ditch, cross-ditch, or right-of-way you must get approval from DOTD and DHH.  
CAUTION: To obtain coverage the water of the state actually receiving the discharge must be identified; if the discharge initially enters a storm water collection system or unnamed ditch, the first named waterbody receiving the discharge must be identified.  The public notice must be published once and proof of publication along with a copy of the public notice and the date of publication must be provided by the applicant to this Office within sixty (60) days after submitting the completed NOI.  The notice shall be published immediately after submittal of the NOI. (Facilities with a valid NPDES or LPDES individual permit are not required to public notice their intent to seek coverage under this general permit.) If the applicant does not provide the required proof of publication within sixty (60) after submitting the NOI, the NOI will be considered withdrawn and the facility file will be inactivated.  In order to activate an inactive file, the applicant will be required to submit a new NOI and with the required proof of publication.

Application for Automotive Dealership, Paint & Body Shop, Automotive Repair Facilities, Motorcycle Dealership and Recreational Vehicle Dealership General Permit

If your business is one of these: Automotive Dealership, Paint & Body Shop, Automotive Repair Facility, Motorcycle Dealership or Recreational Vehicle Dealership you need an LPDES "Notice of Intent."


In most cases this will require that you file the following: An original and one copy of  
General Permit Notice of Intent (NOI) ARB-G form, completely filled out. Do NOT leave any blanks on the form. If the question is not applicable, indicate this with "n/a."


You are required to attach a U.S.G.S. Quadrangle map that is marked with your site's location. And you must attach a "Site/Flow diagram"to the original and the copy.

If your stormwater and/or wastewater will discharge across to a state highway ditich, cross-ditch, or right of way you must also obtain approval from the Louisiana Department of Transportation and Development and the Louisiana Department of Health and Hospitals.

If you meet the applicability requirements you can discharge wastewater and/or stormwater under the terms and conditions of the permit 48 hours after you deliver or DEQ receives your NOI.

The LDEQ, Office of Environmental Services, is accepting written comments on a  Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for City of Morgan City, City of Morgan City Wastewater Treatment Plant, P.O. Box 1218, Morgan City, LA  70381.  The facility is located at 2001 Young's Road in Morgan City, St. Mary Parish.  Upon the effective date of the final permit, the LPDES permit shall replace the previously issued LPDES permit.

The principal discharge from this  source  made into Bayou Boeuf; thence into Bayou Shaffer; thence into the Atchafalaya River, waters of the state classified for primary contact recreation, secondary contact recreation and propagation of fish and wildlife.  Under the SIC  4952, the applicant proposes to discharge treated sanitary wastewater from a publicly owned treatment works serving the City of Morgan City.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

The LDEQ, Office of Environmental Services, is accepting written comments on a  Louisiana Pollutant Discharge Elimination System (LPDES) permit prepared for TOTAL Petrochemical & Refining USA, Inc., Carville Polystyrene Plant, Post Office Box 98, Carville, Louisiana  70721.  The facility is located at 6225 Highway 75 in Carville, Iberville Parish.  Upon the effective date of the final permit, the LPDES permit shall replace the previously issued LPDES permit.

The principal discharge from this  source  made into Bayou Braud via local drainage, waters of the state classified for primary contact recreation, secondary contact recreation and propagation of fish and wildlife.  Under the SIC  2821, the applicant proposes to discharge low contamination potential stormwater runoff from developed and undeveloped portions of the site and de-minimis wastewaters including steam trap condensate, fire system test water, eyewash and safety shower water, uncontaminated clarified water, general facility washwater (facility washdown water, irrigation water, dust control, etc.), uncontaminated hydroblast water, low contamination potential stormwater runoff from the hopper car loading area and the main warehouse roof and previously monitored hydrostatic test wastewater from a polystyrene production plant.

The principal discharge from this  source  made into Bayou Choupique, waters of the state classified for primary contact recreation, secondary contact recreation, and propagation of fish and wildlife.  Under the SIC  4953, the applicant proposes to discharge stormwater runoff, treated sanitary wastewater, treated and/or untreated pressure relief water and vehicle washwater from a hazardous and non-hazardous industrial liquid and solid waste management facility.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.

The principal discharge from this  source  made into Mississippi River, waters of the state classified for primary contact recreation, secondary contact recreation, propagation of fish and wildlife, and drinking water supply.  Under the SIC  4499, the applicant proposes to discharge bilge water, stormwater runoff, and treated sanitary wastewater from an existing crewboat landing and loading dock.

During the preparation of this permit, it has been determined that the discharge will have no adverse impact on the existing uses of the receiving waterbody.  As with any discharge, however, some change in existing water quality may occur.
